Please read these Terms and Conditions ("Terms," "Terms of Service") carefully before using the mobile application, Hillpods (the "App"), and the associated web platform (the "Site," and together with the App, the "Service") operated by Hillpods ("us," "we," or "our").

1. Agreement to Terms

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

2. Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by this reference. Please review the Privacy Policy at

3. Hillpods Platform Role and Limitations

Hillpods is a technology platform designed to connect passengers ("Riders") with independent transportation providers ("Drivers"). Hillpods serves as an intermediary technology platform that facilitates transportation services between Riders and Drivers.

  • Technology Platform Only: Hillpods is a technology company that provides a digital platform connecting Riders and Drivers. We are not a transportation company.

  • Independent Contractors: All Drivers using our platform are independent contractors, not employees, agents, or joint ventures of Hillpods.

  • Intermediary Service: We act solely as an intermediary, facilitating connections, ride booking, payment processing, and communication. Our function is limited to that of a digital platform connecting users and drivers.

  • No Direct Service Provision: Hillpods does not own, operate, or control any vehicles used for transportation services and expressly disclaims any responsibility or liability for the transportation services themselves.

4. Accounts and Registration

If the Service requires you to create an account:

  • You must be at least 18 years old to use the Service.

  • You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or device.

  • You agree to accept responsibility for all activities that occur under your account or password.

  • We reserve the right to refuse service, terminate accounts, or remove or edit content at our sole discretion.

5. Intellectual Property Rights

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Hillpods and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

6. Service Charges and Fees

Hillpods charges fees for the technology services we provide, which include: platform usage and maintenance, payment processing services, GPS and navigation services, customer support, and technology infrastructure.

  • Fee Transparency: All applicable fees and charges (which may vary based on location, time, demand, and other factors) are clearly displayed in the App before booking confirmation.

  • Payment: You agree to pay all fares, service charges, and any applicable taxes incurred through your use of the Service.

7. Rider and Driver Responsibilities

Riders agree to:

  • Provide accurate pickup and destination information.

  • Behave respectfully toward Drivers and other individuals.

  • Pay all applicable fares and fees.

  • Follow local laws and platform guidelines.

Drivers agree to:

  • Maintain valid licenses and insurance.

  • Provide safe and reliable transportation.

  • Follow all traffic laws and regulations.

  • Maintain vehicle safety and operational standards.

8. Prohibited Conduct

You agree not to use the Service to:

  • Violate any local, state, national, or international law or regulation.

  • Harass, abuse, or harm another person or entity, including Drivers, Riders, and Hillpods staff.

  • Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.

  • Use the Service for any unlawful or fraudulent purpose, or to collect personal data from other users without their consent.

  • Attempt to gain unauthorized access to the Service, or any systems or networks connected to the Service.

  • Transmit any harmful or disruptive code, viruses, or worms.

  • Engage in any form of cheating or manipulation of the fare or rating system.

9. Insurance and Safety

Drivers are required to maintain appropriate insurance coverage for their vehicles and commercial transportation activities. Hillpods does not provide insurance coverage for rides and is not responsible for insurance claims or coverage disputes.

10. Limitation of Liability

Hillpods operates solely as a technology platform and intermediary service. In no event shall Hillpods, nor its directors, employees, partners, agents, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, or for any claims, damages, or losses arising out of or relating to the transportation services provided by Drivers, including without limitation, liability for:

  • The quality, safety, or legality of transportation services provided by Drivers.

  • Driver or Rider behavior, actions, or omissions during rides or interactions.

  • Vehicle condition, maintenance, or safety.

  • Accidents, injuries, or damages occurring during transportation.

  • Lost or damaged personal property.

  • Driver compliance with local laws and regulations.

  • Route selection or driving decisions made by Drivers.

11. Indemnification

You agree to indemnify and hold harmless Hillpods and its affiliates, officers, agents, employees, and partners from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your interaction with any Driver or Rider, or the provision or use of transportation services; or (d) your violation of any third-party right, including without limitation, any intellectual property right or privacy right.

12. Disclaimer of Warranties

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance. Hillpods does not guarantee uninterrupted service or platform availability.

13. Dispute Resolution

Any disputes between Riders and Drivers regarding the transportation service (e.g., service quality, fare calculation, personal conduct) should be resolved directly between the parties involved. Hillpods may assist in facilitating communication or gathering information, but is not responsible for providing a thorough resolution, resolving the dispute entirely, or providing compensation for issues arising from transportation services.

14. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service and contact us to request account deletion.

15. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of India, specifically within the jurisdiction of the courts located in the State of Himachal Pradesh, without regard to its conflict of law provisions.

16. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
